Acknowledgment and Acceptance of Terms
Selling Price and Taxes of Publishing
You have to publish a self-written or legally-authorized work at Pubu and set a selling price. The Company will set the deduction of relevant tax and expenses under the provisions of the law of the Republic of China.
In accordance with the Regulations of Business Tax and Income Tax for Online Trading announced by the Ministry of Finance in 2005/5/4, any registered business owner with a monthly labor service over NT$60,000 and monthly product sale over NT$80,000 is liable to pay business tax. Taxes derived from the income of the sales of the book will be paid by the seller of the book.
Publishing & Transaction Fees
When you publish a product at Pubu and set a price, you agree to commission Pubu to collect the price of the product, and agree to pay Pubu publishing fees as follows:
Books: Including 35% of the price of the product plus the delivery cost as your content file size multiplied by NT$0.15/MB. For example, for a product priced at NT$100 with file size of 10MB, you shall pay Pubu NT$37 as publishing fees, in that case Pubu will pay you NT$63, and so on and so forth. But if the payment percentage is less than 50% of the price of the product, we will still pay you 50% of the price of the product.
Media: 50% of the price of the product.
You also agree that Pubu will deduct the publishing fees and then pay you the remaining sum. For all publications priced below NT$4, Pubu will charge NT$1 as publishing fees. You don't have to pay any publishing fees to Pubu for any publications set as free of charge. Should you sign up for collaboration with the Company, the publishing fees will be set otherwise by both parties.
Once you have sold your publications at Pubu and completed the payment and transaction procedures, your amount of income after deducting the transaction fees will be listed in details in your Pubu virtual account for a specified period of time. The details of the specific period of time are as follows:
For non-series publications, payments will be credited to the author's accounts 7 days after the buyers have made the payment, provided that the publications are not returned and that no other disputes arise.
Content Policy and Publishing Guidelines
When you publish self-written or legally-authorized work at Pubu, you shall comply with, including but not limited to, the following and the laws of the Republic of China, and this policy applies to any work that you publish at Pubu, and any contents you set as public from the publishing back end of Pubu. If you violate this agreement, you should bear the relevant legal liability and compensate the Company for any losses (including but not limited to legal costs and legal fees).
Pornography and Nudity: The title of the book, book cover and the contents shall not contain violence, sexual abuse, beastiality or other contents without artistic, medical or educational value. And for contents related to the portrayal and exposition of sex organs, sexual intercourse and sex culture, apart from the above mentioned violence, sexual abuse, beastiality or other contents without artistic, medical or educational value, you shall label the book as "restricted" at the publishing back end. Apart from the title of the product, you are not allowed to publish any text, image or content about sexual content on the product cover, belly band or anywhere that Pubu viewers may see. After you have labeled the book as "restricted", thereafter the Company will take "appropriate safety precautions" (including but not limited to, hiding the cover of the book or remove part of the contents related to sex) when the book is published on Pubu so that most people will not see it.
Pornographic Shopping Guide: Do not link the contents to pornographic sites, sexual service or other pornographic acts.
Intellectual Property Rights: The work shall have legal copyrights and related rights (including but not limited to intellectual property rights), and the author shall guarantee that the work itself does not infringe the rights of others or violate the laws of the Republic of China.
Content Authorization: The work shall be authorized by the owner (including but not limited to copyrights owner and personality rights owner).
Impersonate or Deceive: Do not impersonate others or mislead other Pubu readers to believe that the book is published by you or by an unauthorized person. The cover, title, keywords of the book shall not be false or misleading.
Duplication: Unless there is a wrong conversion, changes to the copyrights and other necessary corrections, or other factors such as having to confirm to reality, the same or similar works should not be published repeatedly on Pubu, including but not limited to dividing a product into multiple products, or merely the change of cover, title, publication date, etc,. If you violate this provision and cause confusion to Pubu readers and consumer disputes, you hereby agree that the Company will deduct 10% of your monthly income from your account as punitive damages.
Due to the large number of publications on Pubu website, the Company is unable to review each of the sources of your copyrights. Therefore, your work can only be published on Pubu if you can guarantee that all the works that you publish on the Pubu website have the legal rights, and do not infringe the rights of others or violate the laws of the Republic of China.
Any reports to the Company that your publication on Pubu is in any way infringing on the rights of others or, is illegal, or that the contents are not original, not sellable (no sales record for 3 months), or that the publication has a consumer dispute, the Company is obliged to immediately remove the work after receiving the report or discovering the issue itself. You may be stopped or forbidden from using all or part of the Service.
If you violate this agreement, you should bear the relevant legal liability and compensate the Company for any losses (including but not limited to legal costs and legal fees).
Intellectual Property Ownership
The rights of the books that you provide are still owned by you or your authorized person.
When you use the Service, you or your authorized person shall agree that the Company may use the published works for the publicity and promotion of the Pubu website, and re-authorize others for the purposes listed above, including the use of printed materials, digital publications and web contents, such as remake, public display and public transmission and so on. You or your authorized person shall agree that the Company may adjust the content, length and image pixels, proportions, and format, or otherwise make reasonable editorial work in accordance with the layout and design requirements. However, the Company shall not distort the original meaning of the written and pictorial contents, and shall not be defamatory, obscene or insulting.
Publishing Back End
The works you have published on the Pubu website are directly translated into eBook files through the Company's specially set-up programs and technologies. You shall not transfer the product files generated through Pubu publishing back end directly to your self-built platform or other platforms. Should the Company discover that you have breached this agreement; the Company may ask you for the price of your works sold on other platforms multiplied by the quantity as punitive damages, except where you use the original file of your own work.
Anything not provided in this Agreement shall be subject to "Pubu Membership and Terms of Service" and "Pubu Corporate Membership and Terms of Service".
